I have been emailing but no response. my email is piakisj@outlook.com I think you said one of my mails went to the junk folder. 1.one question I have is that if a married couple lives in the same house and each have a car, since tort exemption, "follows the car" if they borrow each others car for the day then they are not covered by tort exemption? OR lets say I borrow someone's car and they have PIP. can I use their PIP for Tort exemption? or better yet give an example of someone who loses tort exemption and the followed the PIP laws. 2. do all the Homeowners forms have E and F liability and medical payments, I think they do.

Hi Joe,

If someone who does not have PIP insurance is driving the vehicle of someone who has complied with the No-Fault Law, the exemption is given to the person driving the vehicle.  The opposite is also true.  If someone who complies with the No-Fault Law is driving a vehicle that doesn't comply with the law, they are not tort exempt.  You cannot use someone else's PIP, but you can use their tort exemption when you are driving their vehicle.

All HO policies are "package policies" and they have section II liability and med pay.  Section II is not automatically included in Dwelling policies and must be added by endorsement.
