John and his wife, Mary, have a PAP with John being the named insured. John moved out of their house 120 days ago in contemplation of divorce. During this period of separation, Mary normally drives a Buick insured under John's PAP. Which of the following claims could be covered by John's PAP?

A. All of the answers are correct

B. Mary borrows her brother's pickup to move furniture, and has an at-fault accident

C. Mary borrows her sister's pickup truck to move furniture, and has an at-fault accident

D. Mary lets her unlicensed brother borrow the covered Buick, and he has an at-fault accident

 

Says correct answer is D. I don't see how this is possible, when 1) Mary and John are not living together 120 days ago 2) her brother doesn't have a driver's license.

 

Is it because it hasn't been over 120 days since he moved out??

How an insurance policy can cover an unlicensed person?? Is it because Mary's brother had her permission?

Hi Laura,

It's important to remember that insurance policies don't deal with divorces or separations.  Insurance covers the vehicle and injuries resulting from the vehicle.  The Buick is insured under John's policy, so this policy will pay for claims involving the vehicle.

There will be repercussions from this accident.  I'm sure Mary's brother will ticketed and fined (maybe arrested) for driving without a license and John's insurance company may cancel his insurance for allowing an unlicensed driver to use the vehicle.  But, John's insurance will pay the claim(s) because the Buick is a covered auto on the policy.
